The ruling on Jan. 23, 1973 opened it up to a federal matter when SCOTUS said that the right to abortion was constitutionally protected. So Kerry was right in 1972, and he was right thirteen years later. Note that Kerry made that statement in October 1972, which was three months before the Supreme Court ruled on Roe v. Wade.
